Franklin is published by MOBIPROD, a French société par actions simplifiée with share capital of €1,000, registered with the Nanterre Trade and Companies Register under number 902 218 197, whose registered office is at 32 rue de Paris, 92100 Boulogne-Billancourt, France. By using the app you accept these terms of use. Please read them carefully.
These terms apply whether you use Franklin with an account or without one.
Who can use Franklin
Franklin is intended for adults preparing for the arrival of a child. You must be at least 15 to create an account. One account per person.
Acceptable use
You agree to use Franklin for its intended purpose: discovering and rating first names, alone or with the people close to you. You must not:
- use the app for unlawful purposes;
- impersonate anyone else;
- attempt to access other accounts without permission;
- use automated systems to access the app or extract its content;
- harass, threaten or pester other users.
Your first name and your handle
The first name you choose, and the public handle derived from it, are visible to your relations. They must not be abusive or hateful, and must not suggest that you are somebody else or a representative of Franklin. We filter certain terms automatically and reserve the right to change or refuse a name that breaks this rule.
Reporting and blocking
Any profile can be reported or blocked from within the app. Blocking someone ends your relation and makes you invisible to each other. We review reports and may, depending on their seriousness, warn, suspend or delete an account.
Your account
You are responsible for keeping your access confidential and for activity carried out from your account. You must provide accurate information when creating it.
Content and data
The name database is provided for personal, non-commercial use. The ratings and preferences you create belong to you. By using the relations features, you agree to share your ratings with the people you connect to.
The app, its name, its interface and its editorial content are protected and remain the property of MOBIPROD.
Subscription and purchases
Franklin is free. An optional subscription, Franklin Pro, unlocks additional features. It is offered as an auto-renewing monthly subscription and as a one-off lifetime purchase.
- The price and the duration are shown in the app before any purchase.
- The sale is made by Apple, through your App Store account, and is governed by Apple’s terms of service. We neither receive nor store any card details; Apple only sends us the transaction information (plan, dates, price paid, any refund).
- The monthly subscription renews automatically at the end of each period unless cancelled at least 24 hours before it ends.
- Cancellation is done in your App Store account settings. It takes effect at the end of the period you have already paid for, during which you keep your access.
- Deleting your Franklin account does not cancel your subscription: they are two separate systems. Cancel with the App Store first.
- Refund requests go to Apple, the sole party to the transaction.
Partner content
The Promo tab may present partner offers. Such content is identified as such. The offers come from third parties, who are solely responsible for them: we do not guarantee their availability, their fulfilment, or the content of the sites they lead to. Any contract arising from one of these offers is formed directly between you and the partner concerned.
Availability
We do our best to keep Franklin available, without being able to guarantee it at all times. The app may change, and some features may be modified or withdrawn. Should the service be discontinued, we would tell you within a reasonable time.
Suspending and closing an account
You can delete your account at any time from Help and support.
On our side, we may restrict, suspend or close an account where:
- it breaches these terms;
- we suspect fraud, impersonation or misuse of the app;
- its activity puts other users, security, or the proper running of the service at risk;
- a legal obligation or a decision of a competent authority requires it.
Where the situation presents an immediate risk, the measure may be applied without notice; otherwise we tell you beforehand. We give you the reason for the measure, and you can challenge it by writing to contact.franklin.app@gmail.com; we will then review the decision.
If you are a subscriber and the measure does not follow a breach on your part, the unused portion of your subscription is refunded. An account suspended for a prolonged period may be closed, and its data is then handled in line with our Privacy Policy.
Liability
Franklin is a decision aid: the name database is informational and has no official status. To the extent permitted by law, we are not liable for indirect damage arising from your use of the app. These limitations do not affect the statutory rights you have as a consumer.
Changes to these terms
We may update these terms. We will tell you about significant changes in the app. Continued use after they take effect counts as acceptance.
Governing law
These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first. You may also refer the matter, free of charge, to a consumer mediator.
